Terms of Service

These Terms of Service ("Terms") govern your use of crabbily.com (the "Site") and any order you place on it. They work alongside our Privacy Policy, Shipping Policy and Refund and Returns Policy. By browsing the Site or placing an order you accept them. If you do not accept them, please do not use the Site.

1. Who you are dealing with

Crabbily is the trading name of SKIRT SLATE LLC, based in VERSAILLES, MO. We sell Outdoor Kitchen & Pets products through this online store and nowhere else.

2. Eligibility and accurate information

To order from us you must be at least 18 years old, or have the consent of a parent or legal guardian. You agree that the information you give us, particularly the shipping address and contact details, is accurate, current and complete. A parcel sent to an address you typed incorrectly is not something we can recall.

3. Your account

If you create an account, you are responsible for keeping your login details confidential and for everything done under that login. Tell us at support@crabbily.com immediately if you suspect someone else has access to it.

4. Products and availability

Every product is described on its own page, using the specifications and measurements the manufacturer states. We may change, update or discontinue any listing at any time without notice. Screens differ, so colours may not reproduce exactly. Where a description contains an obvious error, we reserve the right to correct it.

5. Prices, taxes and currency

All prices are shown on the Site in US Dollars (USD) and exclude applicable sales tax unless stated otherwise. The checkout shows the complete total, product price plus any tax, before you confirm. We may change prices at any time, but never after you have placed an order. We reserve the right to correct pricing errors, including after an order is placed, in which case we will contact you and you may cancel.

6. Orders and acceptance

Your order is an offer to buy. It is accepted when we send the shipping confirmation, not when the checkout page loads. We may decline or cancel an order where stock has run out, where a pricing or description error has occurred, or where we suspect fraud.

7. Payment

We accept Shop Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken securely at checkout through Shopify Payments. There are no hidden fees: everything you will be charged appears on screen before you confirm.

8. Shipping

We ship within the United States only, to all 50 states, and we do not ship internationally. Standard shipping is free on every order with no minimum. Full details, including processing and transit times, are in our Shipping Policy.

9. Cancellations

If you need to cancel, write to support@crabbily.com as soon as you can. We move orders quickly, so an order that has already been processed or dispatched may not be cancellable.

10. Returns and refunds

We accept returns for manufacturing defects, transit damage and wrong items received. Change of mind is not a ground for return. The eligibility rules, the time limits and the procedure are set out in full in our Refund and Returns Policy, which forms part of these Terms.

11. Acceptable use

When using the Site, you agree not to:

• use it for any unlawful or fraudulent purpose;
• interfere with its security, availability or normal operation;
• scrape, copy, republish or reproduce its content without our written permission;
• upload malicious code or anything designed to cause harm;
• attempt to gain unauthorised access to any part of the Site, its servers or another user's account.

12. Intellectual property

The content of this Site, including its text, product photography, graphics, layout and logos, is owned by or licensed to Crabbily and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, publish or create derivative works from it without our prior written consent. Nothing on the Site transfers any ownership right to you.

13. Disclaimer of warranties

The Site and the products are provided on an "as is" and "as available" basis. We work hard to keep the information on it accurate and the store running, but we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, and we do not warrant that every description is free of typographical error. Nothing here excludes any warranty that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Crabbily and SKIRT SLATE LLC are not liable for indirect, incidental, special, consequential or punitive damages arising out of your use of the Site or your purchase of any product, including loss of data, loss of revenue and loss of profits. Where liability cannot be excluded, it is limited to the amount you paid for the product in question.

15. Indemnity

You agree to indemnify and hold harmless Crabbily and SKIRT SLATE LLC, together with their officers and employees, against claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the Site.

16. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what we collect, why, and who else sees it.

17. Governing law

These Terms are governed by the laws of the State of Missouri and of the United States. Any dispute arising out of these Terms or your use of the Site will be brought in the courts located in State of Missouri, and you agree to that venue.

18. Changes to these Terms

We may revise these Terms from time to time. The revised version is posted on this page with a new effective date, and continuing to use the Site after that point means you accept it.

19. Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest remains in force. Together with the policies referred to above, these Terms are the entire agreement between you and us regarding the Site.
